3. Intellectual Property

All content, features, and functionality on the Service (including but not limited to all information, software, text, displays, images, video, and audio) are the property of ByWorkr, its licensors, or other providers of such material and are protected by international copyright laws.

4. Limitation of Liability

In no event shall ByWorkr, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

Refund & Cancellation Policy

1. Cancellation of Services

Clients may cancel a project or subscription at any time. Cancellation details depend on the service type:

  • Subscription Plans: Cancellation takes effect at the end of the current billing cycle. No immediate refund is issued for the unused portion of the month.
  • Project Work: If work has commenced, cancellation is subject to a review of work completed, and the freelancer will be compensated for hours worked up to the point of cancellation.

2. Refund Conditions

Refunds are granted only under specific circumstances, such as demonstrable failure to deliver the service as outlined in the project agreement or platform service level agreement (SLA). All refund requests must be submitted within 7 days of project completion or subscription auto-renewal.

3. Dispute Resolution

For any refund disputes, please utilize the ByWorkr Dispute Resolution Center. Our team will mediate the conflict and issue a final decision within 14 business days.
